Legislative framework:

The main law governing this right is the Law of Return (1950), as amended. A key amendment was made in 1970, extending the right of repatriation to children and grandchildren of Jews, as well as their spouses.

Who is eligible:

Minor children (under 18 years of age) of non-Jews married to Jews. This right applies to both biological and adopted children.

Procedure:

1. Filing an application:

The application is submitted to the Israeli consulate in the country of residence or to the Israeli Ministry of Interior if the family is already in the country.

The application is usually submitted with the application of a Jewish parent or a parent married to a Jew.

2. Documents required:

– Child’s birth certificate

– Documents proving the Jewishness of one of the parents (usually documents of the Jewish parent)

– Marriage certificate of the parents

– Passports of both parents and the child

– Photographs of the child

– Adoption documents (if applicable)

3. Verification:

The Ministry of the Interior verifies all documents submitted.

Additional information or documents may be requested.

4. The complexities and peculiarities of the process:

(a) Proof of Jewishness:

It is often difficult to prove the Jewishness of a parent, especially if the documents are lost or insufficient. Misrad Apnim (Ministry of Interior) may require additional evidence, including documentation of the Jewishness of grandparents.

(b) Marriage status of the parents:

If the parents’ marriage is dissolved, this can complicate the process. It is necessary to prove that the marriage existed at the time of the child’s birth.

c) The age of the child:

It is important that the child is a minor at the time of application. If the process is delayed and the child turns 18, difficulties may arise.

d) Adopted children:

For adopted children, the process can be more complicated, requiring all adoption documents and proof of legality.

5. Interpretation of the law:

Misrad Apnim often interprets the law strictly, seeking to limit the number of persons eligible for repatriation. This can lead to additional checks and inquiries.

6. Process duration:

The process can take several months or even years, especially if additional checks or documents are required.

Rights after citizenship:

Once the application is approved, children are granted “ole” (repatriate) status with all the attendant rights and benefits.

They are eligible for Israeli citizenship as soon as they arrive in Israel.

7. Appeal:

In the event of a refusal, you can appeal. This often requires the assistance of a lawyer specializing in Israeli immigration law.

In the context of the topic Israeli citizenship for minor children of foreign Jewish spouses, it is important to note that the practice of the law may vary and each case is considered individually. Therefore, it is advisable to consult an Israeli immigration law specialist or official authorities to obtain the most up-to-date information and assistance in a particular situation.
